WE NEED ALL HANDS ON DECK TO ENSURE THE MOTION IS FAIRLY CONSIDERED!

Arguments will be heard for and against the Defense Counsel’s 50-a motion requesting judicial inspection of Police Officer Grantley Bovell’s (Shield No. 17743) personnel file for facts relevant to the trial—and, if warranted, disclosure of pertinent records for use in Cecily’s defense.

Come support Cecily and bear public witness to the first motion of it’s kind in Occupy History! The Defense will begin their fight to get Officer Bovell’s confidential record turned over for use in Cecily’s defense. Based on existing evidence pointing to his violent and corrupt character, her Counsel will argue that Bovell’s records will likely reveal motive to falsify testimony and illuminate prior questionable conduct of peculiar relevance to Cecily’s case.

“Here,” the motion reads, "creating a basis to fabricate an arrest after assaulting a defendant and claiming an injury in prior situations leads to the conclusion that the personnel records are likely to show similar conduct by the officer [during Cecily’s arrest]”

Joining Assistant District Attorney Erin Choi will be Nicholas Reale, representing the NYPD, in the effort to keep Officer Bovell’s records sealed.

While it seems obvious that existing evidence should compel Judge Zweibel to at least agree to review Officer Bovell’s file, the decision is left totally up to his discretion and conception of “relevance.” Zweibel could just as easily rule that Bovell’s dicey history doesn’t matter—bad cop or good cop, you can’t hit a cop.
