AB 1428 (Low) : Lack of Transparency for Peace Officer Malpractice
Under AB 1428, California law will be more secretive than other states and:
- Deny the public access to investigations and other information about police shootings, including information about any corrective actions departments took
- Deny people information as to why a complaint was not sustained and if it is sustained, the complainant will still be denied information about what corrective action was taken;
- Bar police departments from sharing their full investigations into confirmed officer misconduct;
- Deny civilian oversight bodies and local governments access to the police department records they need to supervise and hold officers accountable for their actions
- Deny families modest, but invaluable information about what happened
during the last minutes of their loved one’s life when police use deadly
force
