Don’t Undo California’s ADU Progress — Oppose AB 1055

UPDATE 4/24/2025: Thanks to your overwhelming support, the assembly member has withdrawn their bill from the agenda and this will become a 2 year bill. This gives us time to work with the author and removes the threat to ADUs for this legislative session. Congratulations and thank you!

Protect Your Right to Build ADUs

California’s ADU success is under attack. AB 1055 would let cities require proof of residential occupancy for 6 months of each year by homeowners who build ADUs, with enforcement by cities and counties and fines for those who don't meet the required use.

This bill makes it harder to build housing when we need it most.

Tell your Assemblymember: Oppose AB 1055

Don't worry if you don't know your assemblymember's contact details – fill the form on this page and we'll find contact information for your specific representative based on your address. We'll also give you a template letter for that representative. You will be able to read the letter, edit it, or send it as it is -- as part of the next step.

If you want more information, you can read the bill or learn about the impact of owner occupancy requirements in this report by the Terner Center at UC Berkeley. Note that the bill text was amended and the legislative digest now specifies "The bill would authorize the local agency to annually recertify, as specified, that the accessory dwelling unit is occupied as a residential dwelling unit for at least 6 months out of each calendar year" which feels like placeholder text to me.
