While some environmental groups have inaccurately declared that we won against CPV. Millennium and CPV are more emboldened then ever after the Federal Energy Regulatory Commission overruled the NYS Department of Environmental Conservation's (NYSDEC) denial of the Valley Lateral Pipeline permit.  With a new Trump appointed Chair FERC has waged an unprecedented assault on states' rights. Days afterward some landowners received new eminent domain papers and are ordered to appear in court today.

Please tell the DEC to appeal the FERC waiver order and file for a stay of construction activities in federal court. Also ask them to be consistent and rescind permits for the Eastern System Upgrade on the same basis as the VLP denial. Tell them DEC must protect NY's water and air quality.
