"description": "Help close New York’s “voluntary intoxication” loophole With your help, we recalled Judge Persky when he gave Stanford swimmer Brock Turner a slap on the wrist for sexually assaulting an unconscious, intoxicated woman behind a dumpster at a frat party. Then in 2024 you joined with us to end the spousal rape exception in California law. Now we need your help to fix New York State law because of what happened at Cornell. Incredibly, under New York law, being voluntarily intoxicated also means that you can be gang raped with impunity. As you probably know, a survivor has revealed that at Cornell University she was sexually brutalized by several fraternity members. She detailed how the men supplied illegal drugs and pressured her to take them until she was incapacitated. Although she went to the police, there were no arrests. There was no prosecution. Many failed this survivor: Cornell, the police, and the DA, and the fraternity members who knew something terrible was happening and did nothing to stop it. But above all, the law failed her. Under current New York law, a perpetrator can get away with raping a victim if the victim voluntarily consumed the alcohol or drug that intoxicated them. Because the vast majority of campus rape occurs when the victim is too intoxicated to consent, this law essentially gives campus rapists a free pass. It’s time to eliminate this outdated, victim-blaming law. For years, advocates have fought to get rid of this barbaric law. This year, the New York State Senate passed a bill to strip this provision from the law. Despite an overwhelming majority in the assembly, Assembly Speaker Carl Heastie refuses to bring this bill to a vote. Join us to send Speaker Carl Heastie an email demanding that he allow a vote to close the voluntary intoxication loophole.",
