The Divisive Concepts law, RSA 194:40 was overturned by a federal judge in 2024 because it is unconstitutionally vague and violates students&#x27; and educators&#x27; 1st and 14th amendment rights. SB 431 does not fool anyone nor will it change the law to make it constitutional. By merely saying an educator has to &quot;intentionally&quot; teach one of the divisive concepts to violate the law still does not address most of the concerns expressed by the court decision. Passing this law will just invite further litigation. The State has better things to do with its revenue than spend it on losing lawsuits. Please contact your representative today and ask them to vote NO on SB 431.",
