"thumbnail_url": "https://actionnetwork.org//images/generic_facebook.jpg",
"description": "I am writing to respectfully request that Philadelphia Common Pleas Court Judge Genece E. Brinkley be investigated for gross misconduct and willful negligence for the unconscionable mishandling of the Robert Williams case. The factual basis for this request arises from Judge Brinkley's Abuse of the Prestige of Judicial Office in her interactions with Robert Williams. She has violated her duty as a Judge by her lack of impartiality, and by committing acts of moral turpitude, dishonesty & corruption. I have reason to believe that this IS NOT an isolated incident. There should be NO mitigating factor in Judge Brinkley’s lack of a ethical conduct. She was elected to the Court of Pleas in 1993, and had been practicing law for over two decades when the misconduct occurred. Judge Brinkley’s lack of impartiality in the case of Robert Williams is astonishing. Judge Brinkley had been practicing long enough to know that her conduct was wrong! Her long list of unethical behavior as provided herein, strongly suggests that she is capable of committing wrongdoing in the future and will likely do so if not fully reprimanded. I am respectfully demand that all of Judge Brinkley’s handling of criminal cases be investigated and/or she be removed from Judicial Office. Here are a few examples of Judge Brinkleys unethical behavior in the mishandling of the Robert Williams case: Judge refused to admit she received emails that she received (and the ADA, who was copied, admitted the ADA had received). Judge stated that Mr. Williams’ video shoot was not approved, however, there is email record of such approval. Judge stated that she believed Mr. Williams’ rehabilitation site was located in California and not Atlanta. However, there is an email confirmation for Atlanta. Judge claimed music performances were booked after her August 31st email to Mr. Williams stating that nothing could be booked until both cases were disposed and until further notice. In fact, nothing was scheduled, and all bookings for dates happened prior to that email. The Judge ignored this testimony. Judge found that Mr. Williams committed technical violations when he was charged with offenses in New York and St. Louis, although law enforcement in both of those jurisdictions determined that the charges should be dismissed. The New York case (which was for popping a wheelie on a motorcycle), was reduced to a traffic violation and dismissed after he completed a driving course. Judge’s ruling went against the stated recommendation of the current ADA and the Probation Officer. Rehabilitation Generally: Mr. Williams struggled with opioid addiction. However, he successfully completed rehabilitation and has tested negative since January 2017 to date. Judge directed Mr. Williams to send his schedule to a former ADA DeSantis, who was no longer working for the Philadelphia’ District Attorney’s office, using her personal Gmail account, despite a new ADA being assigned to the case. Judge refused Mr. Williams access to a transcript of his own legal proceedings in clear violation of his constitutional rights under the U.S. and PA Constitutions. Judge showed up unannounced where Mr. Williams was performing community service, sat at a table to observe, and took it personally that he was sorting clothes for the homeless instead of feeding the homeless. Judge recommended that Mr. Williams hire a new manager. Judge instructed Mr. Williams to record a specific duet of a Boyz II Men with his then-girlfriend Nicki Minaj and dedicate it to the Judge. CONCLUSION Judges should uphold the dignity of judicial office at all times, avoiding both impropriety and the appearance of impropriety in their professional and personal lives. They should at all times conduct themselves in a manner that garners the highest level of public confidence in their independence, fairness, impartiality, integrity, and competence. Judge Brinkley has not shown that she can carry out the duties of a Judge and I respectfully demand that she be investigated and/or removed from the bench. Thank you in advance for your consideration and anticipated cooperation.",
