"description": "Senators Ron Wyden and Sheldon Whitehouse, Chairs of the Senate Finance and Judiciary Committees, have requested Attorney General Merrick Garland appoint a special counsel to investigate Justice Clarence Thomas for potential tax fraud violations. The two committees have been investigating a $267,000 loan to Thomas to purchase a recreational vehicle that was never paid back and was not reported to the IRS as taxable income. The letter to Garland notes the Senate cannot prosecute Thomas, and the Supreme Court can not do fact-finding on its own. This is why, the senators note, the DOJ must appoint a special counsel “to investigate possible violations of federal ethics and tax laws.” Justice Thomas’ failure to disclose multiple luxury gifts and travel from billionaires over several decades constitutes a “breadth of omissions” serious enough to “warrant the appointment of a Special Counsel.” Further, they note the “serious possibility of additional tax fraud and false statement violations by Justice Thomas” requires further investigation. In their request to the Attorney General, Wyden and Whitehouse note that Justice Thomas’ failure to explain why he did not report hundreds of thousands of dollars of forgiven debt on his federal income taxes, together with his evasiveness in answering the Committee’s questions, combine to create not just the need for further investigation -- but the urgency too.
