Across the country, drug companies are suing states to block contract pharmacy access laws that protect access to affordable medications through the 340B Drug Pricing Program. These legal attacks don’t just target policy—they put patients at risk by jeopardizing the fiscal health of their medical homes at community clinics and safety-net hospitals. States are fighting back, but drug companies are deploying enormous legal resources and specialized expertise. Without additional support, state efforts to defend their laws risk being weakened or delayed—not because the laws are legally vulnerable, but because the fight is uneven. The 340B Litigation Defense Fund (LDF) exists to level the playing field. Your support helps ensure states have the legal strength and expert backing they need to defend 340B, so patients don’t lose access to the care and medications they rely on. How the Fund Works LDF is structured as a restricted fund within Community Voices for 340B (CV340B) and will operate through a segregated account to ensure transparency, accountability, and appropriate use of funds. CV340B, led by Executive Director Rhiannon Klein, will oversee and administer LDF to ensure strategic coordination, fiscal management, and stakeholder communication. In evaluating requests for funding through the LDF, a designated LDF subcommittee will consider: How a case aligns with the broader litigation defense strategy within the federal circuit courts Whether supporting the case avoids duplicative litigation, helps prevent unfavorable circuit splits, or preserves favorable interpretations of 340B contract pharmacy access laws The level of financial commitment from local covered entities toward intervention-related legal fees If you or your organization are interested in contributing to the LDF, please fill out this form. If you have any questions please contact: rhiannon.marshall@cv340b.org.
