In June, the Biden administration announced the “Keeping Families Together” Parole process to protect long-time undocumented spouses of United States citizens. The KFT process finally offers mixed status families—who have been waiting in limbo for years—the chance at security, stability, and freedom from the constant fear of being torn apart. After the program went live and started receiving applications on August 19, that same week, Texas and 15 additional states filed a lawsuit and, in addition, a Temporary Restraining Order (TRO) asking the court to immediately block the process. The lawsuit Texas vs. DHS seeks to swiftly end what would be a transformative program in favor of ripping families and communities apart. Eleven individuals, in addition to the Coalition for Humane Immigrant Rights (CHIRLA), have filed a motion to intervene, asking the court to be a party to the lawsuit so that their interests and perspectives are considered by the court rather than just those of the federal government.
