Missouri is one of just two states that lets a judge impose a death sentence when a jury is unable to reach a unanimous decision, a practice known as the "judicial loophole." This outdated and unjust policy enables the views of concerned and conscientious jurors to be disregarded, frequently leading to the suppression of views held by racial, faith, and ethnic minorities. In nearly every other state that allows the death penalty, if the jury cannot unanimously recommend death, the default sentence is life in prison without the possibility of parole. It is time for Missouri to end this harmful practice. Please contact your legislators and ask them to end the judicial loophole in capital cases.
