This results in judges approving warrants without fully understanding the scope of information that cell-site simulators can collect. Warrant applications rarely spell out that cell-site simulators will be used because the companies that sell them often do not allow government agencies to reveal anything about how they work. Defendants have been illegally deprived of the knowledge that a cell-site simulator was the source for evidence against them. Rep. Ted Lieu (D-CA), and Sen. Ron Wyden (D-OR), with Sen. Steve Daines (R-MT), and Rep. Tom McClintock (R-CA) introduced a bill called The Cell-Site Simulator Warrant Act of 2021. This bill would end the obfuscation of cell-site simulator use ensuring its legal deployment and the right of any defendant to be informed about its use.
