But a new federal rule — the ESA “Harm” Rule — threatens one of the Endangered Species Act’s most important safeguards: the longstanding recognition that destroying habitat can cause real harm to endangered and threatened wildlife. Orcas depend on healthy marine ecosystems for food, migration, breeding, and raising their young. When those ecosystems are degraded, when prey disappears, or when important habitat is damaged, their ability to survive and recover is put at risk. Protecting wildlife means protecting the places wildlife depend on. Habitat loss and degradation are among the greatest threats facing wildlife today. Once those places are destroyed, even the strongest protections against directly killing an animal cannot give that species what it needs to survive. For threatened and endangered orcas, protecting individual whales is only part of the equation. They also need healthy waters, abundant food sources, and functioning marine ecosystems to survive and recover. Part of the Endangered Species Act’s success rests on a commonsense principle: we cannot recover endangered wildlife while allowing the destruction of habitat essential to their survival. Tell Congress: Overturn the ESA “Harm” Rule. Support H.R. 9901 and S.J. Res. 204. Defend the habitat protections that species need to survive and recover. We cannot afford to weaken safeguards for endangered wildlife and the habitats that sustain them. From threatened and endangered orcas navigating our oceans to imperiled wildlife across the country, species need more than protection from direct harm.
