This electronic petition is aimed at demanding the handover of Bashar Hafez al-Assad to international justice or national justice for the reasons detailed below. FIRST: THE INTERNATIONAL CRIMES COMMITTED *War Crimes: These include willful killing, the targeting of civilians, the use of prohibited weapons, and the destruction of civilian infrastructure. *Crimes Against Humanity: Such as systematic torture, arbitrary detention, forced displacement, and enforced disappearance. SECOND: CRIMES AND ACTS COMMITTED BY BASHAR HAFEZ AL-ASSAD 1-Mass killing and targeting of civilians with aerial and ground bombardment in multiple areas. 2-Use of poisonous gases in attacks in Eastern Ghouta in 2013, Khan Shay Khun in 2017, and Douma in 2018. 3-Systematic torture and enforced disappearance in security branches and detention centers, documented by Caesar photos. 4-Forced displacement and alteration of the population structure in several areas. 5-Siege and starvation of civilians as a weapon of war. 6-Targeting journalists and media centers, including the bombing of Homs in 2012, which led to the French arrest warrant. 7-Theft of public funds and illicit gain. 8-Practicing systematic enforced disappearance and arbitrary detention of Syrian and Lebanese citizens, and confiscation of their funds and property through illicit means. THIRD: PRINCIPLE OF NON-IMPUNITY AND PRESIDENTIAL IMMUNITY *Non-Impunity: International law affirms that perpetrators of major international crimes cannot seek protection under immunity or political asylum. *Judicial Precedents: International judicial precedents (such as the trial of Milošević in Yugoslavia) establish the feasibility of prosecuting former heads of state. *Scope of Immunity: Immunity does not cover major international crimes. *International Justice: The International Court of Justice and the International Criminal Court have affirmed that crimes against humanity and war crimes are not covered by any type of immunity. FOURTH: UNIVERSAL JURISDICTION *European States: Many European states adopt the principle of universal jurisdiction, which allows for the prosecution of any person who commits grave international crimes, regardless of the location where they occurred. *Extradition: This principle permits the demand for Bashar al-Assad's handover even outside of Syria. FIFTH: INTERNATIONAL CONVENTIONS States have binding obligations under international treaties: *Geneva Conventions: Obligate states to prosecute or extradite persons accused of committing war crimes. *Convention Against Torture: Obligates states to prosecute or extradite any person accused of practicing torture. SIXTH: THE INTERNATIONAL CRIMINAL COURT (ICC) A path for prosecution exists even though Syria is not a State Party to the Rome Statute: Security Council Referral: Although Syria is not a party to the Rome Statute, the UN Security Council can refer the file to the International Criminal Court. International Trial: This opens the door to an international trial for Bashar al-Assad if his extradition to Syria is not feasible. SEVENTH: EVIDENCE OF COMMITTED CRIMES UN Reports: Reports from the United Nations and the International Commission of Inquiry on Syria. Caesar Photos: Caesar photos documenting thousands of cases of torture and killing in detention centers. Human Rights Reports: Reports from international human rights organizations (Human Rights Watch, Amnesty International). OPCW Findings: Results of investigations by the Organization for the Prohibition of Chemical Weapons (OPCW). Survivor and Eyewitness Testimonies. Leaked Official Documents related to the security chain of command. French Arrest Warrants which reinforce the international recognition of the seriousness of the evidence. PROPOSED PATHWAYS FOR ACTION We respectfully direct this petition toward action along the following tracks: A. The Legal Track The objective is to open an official investigation, issue an international arrest warrant, and guarantee the handover of Al-Assad for trial. The French Public Prosecution: (Court de Cassation / Tribunal de Grande Instance) National Prosecution: In states adopting universal jurisdiction (Germany, Sweden, France, Netherlands, Great Britain) The International Criminal Court (ICC): According to Article 15 of the Rome Statute B. The Political and Diplomatic Track The objective is to exert international pressure on Russia and other countries to comply with international law and assist in the handover of Al-Assad. Heads of Major Countries Concerned with the Syrian Issue: (France, the United States, Britain, Germany, Turkey, European Union countries) The UN Secretary-General and the Security Council International Organizations Concerned with Human Rights DEMAND FOR BASHAR AL-ASSAD'S EXTRADITION We, the undersigned, call upon the Russian Federation, represented by its President, Mr. Vladimir Putin, to revoke the status of humanitarian asylum granted by his government to the criminal Bashar Hafez al-Assad and to extradite him for investigation and trial before the competent courts in Syria or in states that adhere to the principle of Universal Jurisdiction. The Syrian people highly appreciate the responsiveness of the Russian Federation, human rights organizations, and international organizations to the aspirations of the Syrian people in achieving justice and retribution from the criminals, foremost among them the aforementioned Bashar Hafez al-Assad.
