In state appeals filed in April, his attorney claimed that Johnson is intellectually disabled and is therefore ineligible for the death penalty, because the U.S. Supreme Court prohibits execution of the intellectually disabled. His petition noted that a new evaluation puts Johnson's IQ at 70, which is generally considered to be intellectually disabled.
