Erny has maintained his innocence of the murder for nearly 50 years. New legal filings present compelling witness testimony that another individual, Cindy Driggers' stepfather (Erny's brother), confessed to the crime and has a history of violence consistent with how she was killed. At the same time, the case against Erny relied on forensic methods that have since been discredited, and critical physical evidence that could have been tested for DNA has been lost or destroyed. Equally troubling, the State of Florida is refusing to release any records about its lethal injection process. Without this information, Erny’s legal team cannot fully challenge whether the method of execution would violate the Constitution.​ Erny has acknowledged wrongdoing, but not the crime for which he is facing execution. At minimum, the courts must be allowed to review this new evidence before the State carries out an execution that cannot be undone.
