After a stay granted by the federal district court and upheld by the 11th Circuit Court, the US Supreme Court overturned the stay and allowed the execution to proceed. Alabama officials started the execution process but ran out of time, and Miller was returned to his cell. At the time that was only the fourth time this has happened since 1972. A new date has been set and Miller is now scheduled to be killed using nitrogen gas asphyxiation (suffocation) on September 26, 2024. Mr. Miller has ineffective assistance of counsel claims at the guilt and penalty phase. Also, Mr. Miller was mentally ill at the time of the crime, suffering from delusional disorder which should have made him ineligible for the death penalty.
