A father of four seeks u-visa decision for being a victim of a crime
USCIS Administrative Appeals Office

On April 8, 2022, beloved Autonomous Tenants Union (ATU) community member Juan Antonio Hernandez Flores (Juan) received a letter from USCIS denying his U-visa application. Juan (A-209-329-910), a long-time resident of Chicago, was a victim of a crime in 2015, which allowed him to look into applying and submitting successfully a u-visa application. However, USCIS is using Juan’s past record as the reason for the rejection, questioning his judgment and saying he does not deserve to be here despite evidence of his integral role in our community.
Juan and his family left their country of origin, Mexico, in hopes for a better life in the US. They have all been living in Chicago since 2005. Juan and his family faced forced eviction in the 2017, which is how they came into contact with ATU. Juan is a beloved father of three U.S. citizens ages 16, 12, 2.
Juan is appealing the decision by USCIS and we would like to show that there is a community behind Juan and his family that believe they are important members of our community and his past record does not define him. Juan is a tenant volunteer with ATU supporting tenants facing eviction and also volunteers with other organizations that have been distributing food and other resources to individuals impacted by COVID. He is deeply loved and trusted by his family, and relied upon as a responsible neighbor and employee.
We ask that you help us by signing this online petition to demand for Juan’s u-visa application to be granted. If granted, it will provide security to him and his family by having access to a legal status to work and stay in this country, and be in connection with their community in Chicago!
If you know Juan and want to add a story or comment we can add to his case, please put that here or feel free to contact us housing.atu@gmail.com
