Investigate Supreme Court Justice Alito Now

First, Supreme Court Justice Samuel Alito was caught flying an upside down American flag outside his home. The flag is a symbol of the pro-Trump “stop the steal” movement that was popularized by those who attacked the U.S. Capitol on January 6, 2021.

Now, the New York Times reports that Justice Alito flew an “Appeal to Heaven” flag outside his beach vacation home. This flag, which was also very popular among January 6 seditionists, is associated with Christian nationalism and support for Donald Trump.

Even before the second flag, Alito faced a chorus of calls to recuse himself from dozens of members of Congress and countless Constitutional scholars.

Predictably, Alito is denying any responsibility. In a statement to Fox News, he blamed his wife for one of the flags that was flown outside his home.

That’s why we’re calling on Senate Judiciary Committee Chairman Dick Durbin to launch an immediate investigation, including hearings, looking into whether Justice Alito is fit to rule on upcoming cases involving Donald Trump.

So far, Sen. Durbin has indicated he isn’t interested in launching an investigation. While he says he believes Alito should recuse himself, he added that “I don't think there's much to be gained with a hearing at this point.”

But that position is quickly becoming untenable. In a May 22 appearance on MSNBC, Congresswoman Alexandria Ocasio-Cortez called for Senate Democrats to launch an “active investigation.”

“What we are seeing here is an extraordinary breach of not just the trust and the stature of the supreme court, but we are seeing a fundamental challenge to our democracy,” Ocasio-Cortez said. “Democrats have a responsibility for defending our democracy.”
