CA Homecare Agencies
An Open Letter to the Home Care Agencies of California,
We, the undersigned, call for your leadership and commitment to the transformation of the homecare industry. We ask you to uphold the dignity and rights of the homecare aides and personal attendants that you employ and the seniors and people with disabilities that you serve by upholding all labor laws.
As domestic workers, families who rely on care work, community members and faith leaders, we write with outrage upon learning about the egregious labor rights violations that took place by Canoga Park-based homecare providers Emelyn Entino Nishi, Joe Derick Regoyal, and their companies Health Alliance Nurses Corp. and Hand Homecare Provider, Inc. More than 200 workers were impacted by grave rights violations related to minimum wage, unpaid overtime, retaliation, and the companies’ illegal misrepresentation as referral agencies – eluding their responsibilities as employers and business owners in the State of California and creating unfair competition for other agencies that are abiding the law.
We applaud Los Angeles City Attorney Mike Feuer’s actions to curb wage theft in the homecare industry and commend him for filing the lawsuit against the Entino Nishi, Regoyal, and their companies, that on October 2, 2018, reached a landmark settlement which included restitution to the impacted caregivers, business injunctions to correct their illegal behavior, and a seven-year monitoring period.
We stand with the homecare aides and attendants whose hard work is invaluable to the lives and well-being of the seniors and people with disabilities in our families and community. We know that the case against Health Alliance and Hand Homecare Inc., is not unique: individuals who work in private homes report frequent abuse across agencies and employers in the homecare industry.
We are moved to join the growing organizing efforts of homecare workers. We call on all homecare agencies across California to improve their business practices and ensure that the industry as a whole is in compliance and upholding the dignity of both the client and the worker.
