2021 is on pace to be the worst year for reproductive rights in decades. And the 6-3 conservative Supreme Court just agreed to weigh in on a case where they can completely dismantle Roe v. Wade once and for all.

The Biden Administration recently established a commission to study the Supreme Court and explore avenues for reform. While this may seem encouraging, the Commission doesn’t plan to publish its findings for six months. We do not have 180 days to wait for the Presidential Commission on the Supreme Court to complete their academic exercise when real lives are at stake.

Stalling for months for a Commission to not even produce recommendations is not a plan — it’s a surrender. Adding four seats is the only practical, proportional response to Republicans’ theft of the Supreme Court, and it’s the only plan that protects women’s rights from Supreme Court conservatives.

And now the 6-3 conservative Court majority just agreed to weigh in on a case where they can overturn precedent and completely dismantle Roe v. Wade. None of this is a surprise: The Supreme Court was stolen by Mitch McConnell — and its theft designed by the Federalist Society — explicitly to overturn Roe and restrict women's rights. And GOP-controlled states know this: that’s why they are attacking reproductive rights at an unprecedented pace, confident that they own the courts.

This is urgent. Seventy-seven percent of Americans believe that abortion should remain legal, but 6 justices could swiftly overturn it. We do not have 180 days to wait for your Commission to complete an academic exercise when the health and well-being of real people are at stake. The only way forward is already clear: It’s time to expand the Supreme Court.

Republicans have dominated the Supreme Court for decades, appointing 15 of the last 19 justices, even though they have lost the popular vote in 7 of the last 8 elections. It has been more than 50 years since a majority of the court was appointed by Democratic presidents. Two-thirds of all Americans have lived their entire lives with a Republican-majority Supreme Court. And that’s likely to continue for decades to come unless we expand the court now.
