HUD is asking the public to weigh in on a proposed rule that would weaken fair housing enforcement by undermining the disparate impact standard and making it harder to hold bad actors accountable.

Disparate impact is a critical civil rights tool that helps people challenge policies that seem “neutral,” but still create discriminatory harm—in lending, tenant screening, insurance, housing access, and more. HUD’s proposal would give banks, landlords, insurers, and real estate brokers more cover to avoid responsibility for discriminatory outcomes.

The Fair Housing Act hasn’t changed. HUD still has a legal obligation to enforce fair housing protections, investigate discrimination, and ensure meaningful remedies. Add your name to tell HUD:

HUD's Implementation of the Fair Housing Act's Disparate Impact Standard

The undersigned individuals and organizations call on HUD to withdraw this proposed rule which does nothing but muddy the waters on HUD’s ongoing legal responsibility to vigorously enforce fair housing law–including the disparate impact standard–and the obligation of banks, landlords, real estate brokers, and others to comply with the law. No matter what the administration says, HUD is still obligated to enforce the Fair Housing Act, and what the law prohibits has not changed.

This administration and HUD leadership want to pretend that discrimination and systemic barriers to fair housing don’t exist, but the facts are clear: fair housing violations and systemic barriers continue to produce discriminatory outcomes that are hurting our communities. Only strong, sustained federal enforcement can meaningfully remedy these ongoing injustices. Instead, HUD has been quietly–and now more openly–shirking its responsibilities, leaving people without the protections and remedies we are legally entitled to.

HUD should withdraw this rule, adequately staff the Department, and get serious about its legally mandated responsibility.
