Resolution from WVMCCD Faculty condemning the WVMCCD Administration for failing its students during the pandemic

WHEREAS, the Colleges have a duty to provide sufficient services and classes to meet the needs of the community, and the faculty are fully committed to a safe and successful campus reopening;

WHEREAS, the District’s communities are entitled to academic and student services;

WHEREAS, the Deans and Vice Presidents have neglected student preference for online courses, demanding more face-to-face classes, with no flexibility nor contingency plans, and many of those classes are now either under enrolled or have been canceled - 217 classes as of 1/21/22. Since the District has sufficient reserves, to cut instructional spending is socially and fiscally irresponsible;

WHEREAS, the lack of evidence-based and student-centered enrollment management is harming students as their classes are canceled and their options restricted, thus forcing them to seek the classes they need elsewhere, or forcing them out of educational pathways;

WHEREAS, the District's COVID implementation is unclear and in conflict with Santa Clara County’s guidelines, due to it being outdated, with no mention of boosters, updated isolation protocols, or new masking requirements;

WHEREAS, the District has failed to verify student vaccine status prior to the start of the semester, contrary to their own, stated procedures;

WHEREAS, without the ability to temporarily move learning online, the faculty are concerned with the impact on student success due to significant COVID-related absences and cancellations as seen in other institutions.

WHEREAS, the District failed to prepare for anything other than the best case scenario, leaving students and faculty exposed with no alternatives, flexibility, nor contingency plans in the face of shifting student demand and new COVID outbreaks;

THEREFORE, be it resolved that the WVMCCD Faculty will exercise our professional responsibilities by temporarily adapting our classes to meet the needs of our students and to comply with the CA Dept of Public Health guidelines.

THEREFORE, be it resolved that WVMCCD Faculty will adhere to all current COVID guidelines of the Santa Clara County Health Dept and the CA Dept of Public Health, whichever is stronger and more likely to protect the community.

THEREFORE, be it resolved that WVMCCD Faculty may, when there is good cause and in the absence of verification of compliance with AP/BP 3960, modify services temporarily to align with Article 12.1 of the WVMFT Contract - “No member shall be assigned to work under conditions which endanger his/her safety or health.”

THEREFORE, be it resolved that WVMCCD Faculty will reject future schedules that are not evidence based and responsive to student needs.

THEREFORE, be it resolved that WVMCCD Faculty will reject any recommended class cancellations that circumvent California Education Code. (Ca. Educ. Code § 87482.8)
