It’s a new year, but the ultra-conservative Supreme Court is up to its same unethical tricks.
In the span of just a few days, we learned that the investigation into the leak of the Court’s decision to overturn Roe v. Wade in Dobbs v. Jackson Women’s Health Organization did not include any real investigation into the Supreme Court justices themselves. Then, at the Sundance Film Festival, director Doug Liman announced a documentary about Brett Kavanaugh, and tips started to pour in.
This news further exposes the failings of Congress to hold the justices of our nation’s highest Court accountable to the people they purport to serve.
Film directors should not have to step in and do the FBI’s job, but that’s exactly what they’re doing. The film exposed that the FBI ignored thousands of tips and wholly failed to investigate at least one additional credible accusation against Kavanaugh. And after the surprise screening of the film at Sundance, so many compelling tips flooded in that the team is adding footage to the film after production.
While the film industry is doing more to hold the Supreme Court accountable than Congress, the Supreme Court Marshal in charge of the investigation into the Dobbs leak is doing even less. All Court staff who had access to the draft opinion signed sworn affidavits affirming they did not leak the decision or know who did, but the justices were not questioned under oath and did not sign any such affidavit.
This failure to meaningfully question the nine people most intimately familiar with the draft decision—and who arguably had the most motive to leak it—completely undermines the credibility of the investigation and of the Supreme Court. To add insult to injury, the Court hired a security firm to validate the investigation—and failed to disclose that it had recently paid that firm at least $1 million for unrelated work.
The Senate Judiciary Committee needs to heed the calls to step in and investigate the Supreme Court. A serial sexual abuser was handed a lifetime appointment on the Court and has managed to evade accountability every step of the way, and now, he and his far-right extremist colleagues are evading accountability for a leak for which all other Court personnel are hiring lawyers, being interrogated, and giving sworn affidavits. This ends now.
