Protect Undocumented Students in Washington State

It is estimated there are 23,000 undocumented children and youth enrolled in pre-kindergarten to 12th grade in Washington State from a multitude of racial and ethnic backgrounds.

A much larger number of children and youth in our state have a parent or family member who is undocumented. These undocumented students and their families, have been particularly under threat since the election cycle, and are experiencing increased uncertainty and fear for their safety.

All students, regardless of immigration status, have a constitutional right to attend public K-12 education (Plyler vs. Doe, 457 U.S. 202, 1982). When students are faced with hostile school environments it greatly affects their academic success as well as their physical and mental health. Students who face victimization and discrimination at school have worse performance outcomes.

Thus, we urge Washington State school districts to support their school staff, undocumented students and families through the following 3 recommended actions:

  1. Be A Safe Space: Make a public statement (board resolution, proclamation, etc.) vowing to create safe spaces for undocumented student and their families.
  2. Uphold Human Rights To Education: Publicly recommit and share with staff, students, and families the rights each school has to ensure undocumented student safety. Specifically, schools have the right to...
    1. Implement hate crime and/or hate language reporting process and procedures to monitor safety.
    2. Protect student and family records and information (FERPA), Including, but not limited to, information that is provided while filing the Free Application for Federal Student Aid (FAFSA), Washington Application for State Financial Aid (WASFA), and college applications. ((FERPA), 20 U.S.C. 1232g and 34 CFR Part 99)
    3. Restrict Immigration and Customs Enforcement (ICE) agents’ access to schools and school districts. (ICE Sensitive Locations, Policy 10029.2, FEA Number: 306-112- 002b)
  3. Educate With Excellence: Train your staff and local community by providing resources and/or trainings to school staff, students and families.
    1. Provide spaces or information where students and families can learn about their rights and the resources available to them.
    2. Train teachers, staff and administrators on current policies and practices to support undocumented students and families.

As a coalition of organizations and people who are devoted to promoting the well-being of students, we feel that implementing these changes institutionally and systemically would further support our undocumented students and their families.

About the K-12 Coalition To Protect Undocumented Students: The coalition serves to ensure the physical safety and emotional well-being of King County K-12 children and youth who are undocumented. We work in collaboration to ensure our schools are a safe and inviting for all students and their families because we know this is paramount to students being able to achieve.

The coalition centers undocumented students of all races and origins. However the coalition does not exclude other marginalized identities such as Muslim students, LGBTQIA+ students, Indigenous students, young womxn and girl students, and students of color or immigrant backgrounds.

Educadores del Estado de Washington, Administradores y Distritos Escolares Protección a Estudiantes Indocumentados en el Estado de Washington Estimados Educadores del Estado de Washington K-12, Administradores y Personal:

Se estima que hay más de 23,000 niños y jóvenes indocumentados inscritos en las escuelas comenzando de pre-kínder al 12º año escolar de una multitud de razas y grupos étnicos en el Estado de Washington.

También, un mayor número de niños y jóvenes en nuestro estado, tienen un padre o un familiar indocumentado. Estos jóvenes indocumentados y sus familiares, se han visto amenazados comenzando el ciclo electoral y están viviendo con incertidumbre y miedo por su seguridad.

Todos los estudiantes, sin importar su estatus migratorio, tienen un derecho constitucional de asistir a educación pública de Pre-kínder a 12º año escolar (Plyler vs. Doe, 457 U.S. 202, 1982). Cuando los estudiantes se enfrentan con un ambiente hostil en la escuela, les afecta enormemente su éxito académico, al igual que su salud física y mental. Estudiantes que son víctimas de discriminación en la escuela, tienen un peor resultado en su empeño escolar. Para usted, como una persona significante en el bienestar físico y emocional de sus estudiantes, este asunto debería ser una prioridad.  

Por consiguiente, le urgimos a todos los distritos escolares en el Estado de Washington que apoyen a todo su personal, estudiantes indocumentados, y sus familiares con las siguientes acciones recomendadas:

  1. Hagan una declaración pública (una resolución de junta directiva, una proclamación, etc.) prometiendo crear un espacio seguro para los estudiantes indocumentados y sus familiares.

  2. Públicamente prometer y hacer un comunicado público de educación y derechos humanos al personal escolar, estudiantes y sus familias:

    1. Restringir acceso a los agentes de Emigración y Aduanas (Immigration and Customs Enforcement (ICE)) a las escuelas y distritos escolares (Póliza de ICE a Localidades Sensitivas 10029.2, numero FEA: 306-112-002b).

    2. Protección de información personal y registros de los estudiantes y sus familiares, bajo la Ley Privacidad y Derechos Educacionales a la Familia (Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. 1232g y 34 CFR Parte 99). Incluyendo, pero no limitándose a archivos e información de estudiantes y sus familiares obtenida durante el proceso de Aplicación de Asistencia Federal Estudiantil (Application for Federal Student Aid (FAFSA)), Aplicación del Estado de Washington para Asistencia Financiera (Washington Application for State Financial Aid (WASFA)) y aplicaciones de colegio.

    3. Poner en proceso una forma de reportar incidentes de Crímenes y/o Lenguaje de Odio.

  3. Proveer recursos adicionales y entrenamientos al personal educativo, estudiantes y sus familias.
    1. Entrenamiento a los maestros, personal y administradores en las pólizas y practicas actuales para apoyar a estudiantes indocumentados y sus familias (un kit de herramientas se proveerá en Enero 2017).
    2. Proveer un espacio o información donde los estudiantes y sus familias puedan aprender acerca de sus derechos y recursos escolares disponibles para ellos.

Como una coalición de organizaciones y un grupo de personas dedicadas a promover el bienestar de los estudiantes, creemos que implementar estos cambios al nivel institucional y sistemático ayudaran a apoyar a nuestros estudiantes indocumentados y a sus familias.

Por favor únase a nosotros para apoyar a nuestra comunidad y continuar sosteniendo la educación y los derechos humanos para todos los estudiantes y sus familias, para que ellos se sientan seguros y protegidos.

Acerca de la Coalición de K-12 Protección Undocu: La coalición sirve para asegurar el bienestar físico y emocional para los niños y jóvenes indocumentados que cursan K-12 en el Condado de King.
