Statement on Threats to Academic Freedom and Free Speech at UVA
UVA Administration
This academic year has seen an escalation in attacks on academic freedom and faculty safety at UVA, spurred by, but not limited to, Israel’s war on Palestine. A faculty member who allowed a student to speak about the divestment campaign in his class was secretly recorded by a student in a breach of UVA policy. That illicit recording was used to report him to the Dean of the College, after which he was called before the dean. Another faculty member, who rescheduled a class in solidarity with the student divestment campaign walkout on February 26th, has been slandered as antisemitic on The Daily Caller, social media, and online. As a result, she has received over 1,700 harassing and threatening emails from people claiming to be UVA parents, and she is facing disciplinary action from the College of Arts and Sciences. Still another professor was similarly doxxed and so severely harassed that security was posted outside her classroom for her protection. A partisan group made a FOIA request for documents from Black and Indigenous faculty members who direct the Black & Indigenous Feminist Futures Institute. A professor teaching a class about the legacy of slavery at UVA has had materials for her course FOIA'd by the same group; other instructors have also received FOIA requests for their syllabi.
Those behind this orchestrated campaign include two extremist lobbying groups: the Jefferson Council and the Friends of the Israel Defense Forces (FIDF) in concert with Mothers Against College Antisemitism (MACA). Joel Nied, a UVA parent who has been quoted in multiple news outlets about Palestine solidarity events on Grounds, is President of the Virginia chapter of FIDF and his wife started the UVA chapter of MACA. Walter Smith, Chair of the Jefferson Council Research Committee, is responsible for over 200 spurious FOIA requests. The Jefferson Council is one of several groups generating defamatory posts about Black UVA faculty, including the Vice President for Diversity, Equity, Inclusion, and Community Partnerships, with the goal of shutting down efforts to promote equity. In the face of these attacks, the UVA administration has refused to respond publicly and has gone so far as to legitimize these antagonists by investigating and threatening to discipline the targeted faculty members.
The harassment that UVA faculty have faced, and the threats of punitive measures from their administrators, has had a chilling effect on academic freedom, speech, and the educational mission of the university. Faculty have been put in the line of fire without any protections. Even principled, measured academic statements that simply report the findings of scholars in our fields, as well as international and Israeli human rights organizations, leave us vulnerable to false accusations and harassment by a small, but vocal contingent of students and parents. We strenuously object to this bad faith weaponization of the very real issue of antisemitism and to the selective concern displayed by the administration for the feelings of some UVA community members at the expense of others.
On March 6, 2024, we put seven requests to the administration, guided by two overarching principles: first, protection for academic freedom and, second, protection from harassment.
1. That the administration engage in no disciplinary action against any faculty member who participated in the walkout on February 26, 2024.
2. That the administration provide faculty with clarification on the process by which complaints against them will be investigated.
3. That the administration email all University instructors affirming section 3.1 of the UVA Faculty Handbook, which stipulates that “Academic faculty have the free speech right to address in any forum any matter that is of social, political, economic, or other interest to the larger community, without restraint beyond that imposed by professional standards and ethics or by law.”
4. That the administration make it clear that political speech is protected and explicitly state that pro-Palestinian speech is protected speech.
5. That the administration protect faculty against slanderous accusations of antisemitism, and affirm that criticisms of the state of Israel are not in and of themselves antisemitic.
6. That the administration make clear, and put in writing, that they will act as a buffer between faculty and parents, and that parents cannot directly contact faculty with complaints. This is in accordance with the AAUP’s stance on political and parental interference with academic freedom.
7. That the administration publicly state its commitment to protect faculty from harassment and articulate steps to be taken when faculty find themselves targeted by orchestrated campaigns to harass, threaten, and discredit them.
We call on faculty and the broader UVA community to sign on to this letter to demonstrate our collective concern about the targeted harassment of faculty, staff, and students, the administration’s failure to ensure fair and clear processes to address complaints, and the greater threat to academic freedom and freedom of speech that these conditions have engendered. These events point to a future that imperils the academic mission of UVA and all institutions of higher education. Swift, explicit, and resolute action to protect academic freedom is necessary.
