Testify in Support of Homeowner Protections

Join Build Our Homes Right on Tuesday, March 18th at the Colorado State Capitol (or virtually via Zoom) to testify in support of homeowner protections. There will be two bills heard before the House Committee on Transportation, Housing & Local Government: HB25-1261 and HB25-1272. More information about those bills can be found below.
HB25-1261 prevents 1) builders and developers from adding language that contradicts current Colorado law in purchase agreements, contracts, and HOA (homeowner association) declarations or that limits a homeowner’s right to address construction problems, 2) ensures that homeowners are able to recover enough to perform necessary repairs to their home and prevents builders from dragging their feet in repairing problems, 3) increases transparency to make it easier for homeowners to determine who is responsible for serious home construction problems on the front end, which promotes early resolution, more narrow claims, and efficiency in the resolution of claims, and 4) will collect information on the market, cost, quality and use of construction liability insurance. Build Our Homes Right fully supports this important bill as it codifies critical protections for homeowners from shoddy construction.
HB25-1272 sets different requirements for homes of different price points, requires third party inspections of homes, encourages early resolution through repairs, allows local governments to offer presumption of no defect, allows builders to run out the clock on defect claims, removes any responsibility for builders for repairs, and changes voting threshold for homeowners in an HOA to approve legal action. There are a number of aspects of this bill that Build Our Homes Right supports; unfortunately, there are also a number of aspects that undermine critical homeowner protections. Because of this, Build Our Homes Right has taken a stance of Amend on this bill.
