This nation was founded on a simple yet profound principle: No one is above the law. Not the president of the United States. Not a former president. And definitely not Donald Trump.
No one.
But on July 1st, the Supreme Court, in a 6-3 decision, ruled that presidents’ have “absolute immunity” for official acts. They granted broad immunity from prosecution for crimes a president may commit in office placing virtually no limits on what a president can do. The only limits will be those that are self-imposed by the person occupying the Oval Office.
It’s not often that a Supreme Court decision is so bad, it requires a constitutional amendment to set the nation on a lawful course again. But the Court’s decision on presidential immunity is that bad.
Biden’s proposed “No One Is Above the Law Amendment” will state that the Constitution does not confer any immunity from federal criminal indictment, trial, conviction, or sentencing by virtue of previously serving as president, making it clear no president is immune from prosecution for crimes committed while in office.
Passing a constitutional amendment isn’t easy. It must be passed by 2/3 of both houses of Congress and ratified by 3/4 of the state legislatures. But it’s been done before -- and we can do it again. It takes real organizing and a long term commitment to fight for what will almost certainly be a multi-year effort.
Republican Speaker of the House Mike Johnson says President Biden’s ideas are dead on arrival. He wants Americans to think that this has no chance, because if we believe him then he’ll win without even putting up a fight.
