RAPE IS RAPE: We Need to Close the Spousal Rape Loophole NOW

California state law makes a very clear-cut distinction between spousal and non-spousal rape, and treats sexual violence committed in marriage as much less serious. The most egregious leniencies afforded to spousal rapists under current law are:

  1. Completed spousal rape is considered a less serious offense than attempted non-spousal rape
  2. Convicted spousal rapists are eligible for probation, while convicted non-spousal rapists are not
  3. SPOUSAL RAPISTS DO NOT HAVE TO REGISTER AS A SEX OFFENDERS EXCEPT IN THE MOST EGGREGIOUS VIOLENT CIRCUMSTANCES
