TELL THE FEC: Investigate Elon Musk’s Election Bribery

Elon Musk just crossed a dangerous line. At a political rally in support of conservative candidate for the Wisconsin Supreme Court Brad Schimel, Musk handed out $1 million checks to two individuals who had signed a petition opposing “activist” judges. His actions came after the Wisconsin Supreme Court refused to block these payments, despite warnings from Attorney General Josh Kaul that they may violate election laws.

Under 18 U.S.C. § 597, offering money or anything of value to influence political outcomes is illegal. Musk’s team claims these payments are protected by the First Amendment, but this is a dangerous distortion of campaign finance law. Rewarding political engagement with million-dollar checks is not free speech, it’s bribery.

Musk’s unchecked financial influence undermines public trust in our democracy. His political groups, America PAC and Building America’s Future, poured over $20 million into Wisconsin’s judicial election, making it the most expensive judicial race in U.S. history. Then, he took things a step further by directly giving individuals $1 million for their “political activity” – more commonly known as “votes.”

We, the undersigned, demand that the FEC immediately investigate Elon Musk’s payments to determine if they violate federal election laws. The FEC must protect the integrity of our elections and ensure that billionaires cannot manipulate political outcomes with financial incentives.
