Lettre à l’appui du journal Le Devoir et de la journaliste Marie Vastel

Une lettre ouverte signée par Noam Chomsky, Roger Waters, Ken Loach, l'ancien député fédéral Jim Manly, le poète El Jones et l'auteur Yann Martel, ainsi que plus de 170 Canadiens, et quantité d’autres citoyens, a été remise au ministre de la Justice David Lametti lui demandant d’enquêter sur le recrutement en cours au Canada pour le compte des Forces de défense israéliennes (FDI). Parallèlement à la lettre ouverte, une plainte officielle a été adressée au ministre de la Justice.

C'est un crime au Canada de recruter des Canadiens pour le compte d’une armée étrangère. C'est aussi un crime d'aider et d'encourager un tel recrutement en offrant des incitations et en encourageant toute personne à servir dans une armée étrangère.

La Loi sur l'enrôlement à l'étranger stipule: «Toute personne qui, au Canada, recrute ou incite d'une autre manière une personne ou un groupe de personnes à s'enrôler ou à accepter une commission ou un engagement dans les forces armées d'un État étranger ou d'autres forces armées opérant dans cet État est coupable d'une infraction. »

La seule exception serait le recrutement de citoyens israéliens qui ne sont pas canadiens.

October 19, 2020, Marie Vastel reported in Le Devoir on the complaint sent to Justice Minister Lametti in regard to illegal Israeli military recruiting in Canada. The following day after asking Minister Lametti about the complaint, Marie Vastel reported in Le Devoir article about his response. The headline read “Police to investigate recruitment of soldiers for Israel, says Ottawa.”

An open letter signed by Noam Chomsky, Roger Waters, Ken Loach, former MP Jim Manly, as well as poet El Jones and author Yann Martel, and more than 170 Canadians as well as several others, has been delivered to Justice Minister David Lametti asking him to investigate recruitment taking place in Canada for the Israel Defense Forces (IDF). Alongside the open letter, a formal legal complaint was sent to the justice minister.

It is a crime in Canada to recruit anyone for a foreign military. It is also a crime to aid and abet such recruitment by offering incentives and encouraging any person to serve in a foreign military.

The Foreign Enlistment Act states, “Any person who, within Canada, recruits or otherwise induces any person or body of persons to enlist or to accept any commission or engagement in the armed forces of any foreign state or other armed forces operating in that state is guilty of an offence.”

The only exception would be the recruitment of Israeli citizens who are not Canadian.
