Juvenile Justice: Treating Children as Children, Not as Adults

Five bills before the current General Assembly collectively address problems with treatment under Delaware law of juveniles in our criminal justice system.

·       HB 9: Permits adjudications of delinquency to be vacated and criminal records to be expunged for crimes (other than violent felonies) committed as a direct result of being a victim of human trafficking.  

·       HB 26 & 27: Transfers jurisdiction over juveniles under 18 years old from the Department of Corrections to the Department of Services to Children, Youth and Their Families.

·       HB 50: Prohibits the release of names and photos of juveniles under the age of 16 who are charged with and/or found delinquent of Class A misdemeanors and certain felonies, including protections for juveniles on social media.

·       HB 115: Prohibits prosecution of juveniles under the age of 12, except for violent crime.
