HB 2486 creates a secret file for conduct records of police, deputies, jailers and 911 call takers that cannot be shared with “any agency or person.” Any documents related to incidents in which the law enforcement agency itself determines “there is insufficient evidence to sustain the charge of misconduct” must be sealed.
This gives a pathway for increased cover ups of misconduct and prevents information about most police and jailor conduct from being shared with DAs and county attorneys, oversight agencies, lawmakers conducting investigations as they did for Uvalde, and anyone else. And it rolls back the gains made in the Sandra Bland Act when a person dies in jail.
