Do Not Pass HB 545

Representatives of Georgia, regarding Bill HB 545

HB 545 must be defeated before June 26 to protect the rural property rights and the people of Georgia! HB 545 planned on forbidding nuisance lawsuits from being brought against newly-established farms or agricultural operations 2 years after such enterprise was established. It was amended to remove the 2-year time frame, but big Agriculture corporations are still pushing for it. Georgia Farm Bureau, Georgia Poultry Federation, and Georgia Agribusiness Council plan to get HB 545 in a Committee of Conference and put it back closer to the original “abomination bill.”

This bill will affect communities of color by allowing corporations to pollute and cause nuisances like odor, polluted well water, environmental damage, etc. without being punished under the nuisance law if the nuisance started after 2 years of the farms opening. Many agricultural businesses do not become a nuisance until the 3rd or 4th year of operation, so it will no longer be able to adequately protect those who face nuisances.

This is environmental injustice and an attack on the nuisance law! Sign this petition to let your Representatives know their constituents are against this bill passing.

Your constituents are against passing HB 545. HB 545 does not add anything positive to the state of Georgia, and the current nuisance law is perfectly adequate. If HB 545 passes like how the Georgia Farm Bureau, Georgia Poultry Federation, and Georgia Agribusiness Council want, the two year statue of limitation will highly prohibit residents from filing against nuisances. Two years is not enough time to see if an agricultural business will become a nuisance or not, and it should be allowed to file against nuisances at any time.
