Because of an abusive practice known as “on-call scheduling, ” many of Connecticut's workers lack the predictability and stability to properly budget, care for their families, and seize and create economic opportunities for themselves and others. This holds back our entire state.

Our legislators can fix this problem the same way it has already been fixed in Oregon, Seattle, Philadelphia, and New York City: By passing a Fair Workweek law to guarantee workers partial compensation when their shifts are canceled without reasonable notice, and ensure time for rest in between closing and opening shifts.

Connecticut’s working people and families need an end to on-call scheduling.

Throughout Connecticut, working families are increasingly at the mercy of unpredictable work schedules. Many low wage employers schedule employees to work with little notice, cancel shifts at the last minute, or require workers to be available for “on-call” shifts without any guarantee of work.

We, the undersigned, demand that Connecticut state legislators pass a Fair Workweek bill that will update our labor laws to make work hours more predictable and reliable for low wage workers in our state.

Many low wage service sector employers require their employees to be “on-call” to work. Workers must contact their employer the night before or the morning of the on-call shift to find out if they will have work. Workers are also often required to be available even though most on-call shifts do not result in any work or compensation. By the time the employee learns she does not have to report to work, she may have turned down other opportunities, paid for childcare, or even started her commute to work—but receives no compensation for her time.

On-call scheduling is holding hard working people in Connecticut back. Working on-call means that working parents must make the tough choice of scrambling last minute to find childcare if they are scheduled, knowing they might need to give up work they desperately need if their babysitter isn’t available. Or working parents must schedule childcare in advance and hope that they get work that day to cover the cost. This is the kind of tough choice that Connecticut’s parents should not have to make.

This is not a new problem, but it is a solvable one. In 2016, Connecticut’s state Attorney General joined a multi-state inquiry into on-call scheduling after becoming concerned about potential violations of the state reporting pay laws. That initiative resulted in six major retailers ending their on-call scheduling, relieving thousands of workers and their families from the burden of putting their lives on hold every day.

Our leaders in Connecticut can stop the most abusive scheduling practices by regulating on-call shifts. State legislators should put an end to last-minute scheduling changes that have low wage workers living their lives on call and update the state’s reporting pay regulations to require partial compensation for work hours cancelled without reasonable notice.

Connecticut can do better.

Connecticut’s legislators can join the national momentum to restore a Fair Workweek for working families.

Now is the time for Connecticut to relieve working families from the burden of on-call scheduling. Common sense limits to on-call scheduling are an important step forward in a pathway out of poverty for Connecticut’s most vulnerable workers and their families.

With Fair Workweek laws, our workers will have the predictability and security they need to budget, raise their families, and create new economic opportunities for themselves.

We all deserve a schedule we can count on.
