Updates: On January 21, ICE postponed Norberto's hearing and transferred him to Illinois, into the custody of local officials. Norberto is an important witness in a criminal investigation into a car crash, and he was moved to Illinois to assist officials in the case. Even though Norberto is now detained in Illinois, his deportation case is still in the El Paso Immigration Court. We continue to demand that the El Paso ICE attorneys grant Norberto prosecutorial discretion so he can return home to his family.

Norberto is in deportation proceedings in El Paso, TX. We are demanding that ICE to use their discretion to stop his deportation and allow Norberto to be reunited with his family and friends. His 9 year old daughter and his family desperately need him back home in Calumet City, Illinois, his home for over 20 years.

Norberto’s detention has been devastating for his loved ones. He has spent the past three and a half years locked up, unable to participate in his family's birthdays, holidays, and funerals. Norberto’s 9 year old daughter misses him, constantly asking for him and writing him letters. Norberto has always taken care of her, ensuring her physical, emotional and financial well-being.

This past year has been especially difficult for Norberto’s family, as they lost his grandmother, grandfather and older brother. Norberto’s nephews have struggled since their father was killed in a horrific accident, and Norberto is needed at home to support them financially and emotionally.

Norberto and his family are an integral part of their community in the Southeast Side and the South Suburbs of Chicago. Norberto grew up, went to school, worked, and raised his daughter in this community. Since he was young, he has participated and volunteered at community events. His family, church, and neighbors miss him and the joy he brings to their community.

Norberto has spent his entire adult life working in agriculture to support his daughter and parents. He is an essential worker, and his former employers have said that they would hire him back as soon as he’s home.

Despite being a lawful permanent resident for over two decades, Norberto was placed in immigration removal proceedings following a criminal conviction in 2019. We believe that he was wrongfully charged and convicted. He is being punished twice: he has had to endure an unjust sentence and now faces the possibility of deportation and separation from his family.

We, the undersigned, urge the Director of the El Paso ICE Field Office to consider the many positive factors in Norberto’s case and use their discretion to allow Norberto to be reunited with his family, friends, and community.
