Sign the Grassroots Amicus Brief: DOGE is Unconstitutional!

A massive coalition of unions and non-profits just filed the largest and most significant legal challenge to President Donald Trump’s attempt to remake the government without Congressional approval.

President Trump gave Elon Musk his blessing to root through the government, recklessly firing workers who process Social Security payments, ensure food safety, care for veterans, and more. There are legal processes for government staff reductions, and Trump unlawfully ignored them.

These lawsuits are working to rein in the administration -- limiting the impact or sometimes stopping them altogether. There aren’t a lot of ways that the public can put pressure on judges to act, but there is one.

Amicus briefs are called “friend of the court” briefs -- they’re a way for groups who aren’t immediately party to a case under consideration to make their own arguments without appearing in court themselves. Often, they’re compiled by fancy think tanks like the Heritage Foundation or the Cato Institute -- but we’re doing this a little differently.

Donald Trump’s campaign of destruction affects all of us. This isn’t just about federal workers. It threatens vital services that Americans depend on every day. That means the court needs to hear from everyday Americans. So we’re compiling a Grassroots Amicus Brief that we can give to our union allies.

Our statement:

We are grassroots Americans concerned about the Trump Administration’s cuts to our government. We believe the DOGE program is an unconstitutional attempt to dismantle our government and eliminate vital services that benefit all Americans.

The President does not have the authority to unilaterally impose staffing cuts and reorganize the federal government without Congressional approval. The Constitution grants Congress the power to appropriate funds and set policy, not the President. By attempting to bypass Congress and impose his own vision for the federal government, President Trump is violating the Constitutional separation of powers and undermining the rule of law.

Furthermore, the DOGE program is being implemented in a secretive and undemocratic manner, without input from Congress or the public. The Trump Administration has refused to release its plans for reducing the federal workforce, despite requests from lawmakers and the public. This lack of transparency and accountability is unacceptable and undermines the principles of good governance.

The DOGE program is based on a flawed assumption that the federal government is "bloated" and "sloppy," and that drastic cuts are needed to reduce its size. However, this approach ignores the important work that federal agencies do to protect our environment, ensure public health and safety, and provide essential services to our communities.

We believe that our government should be working to improve the lives of all Americans, not just a privileged few. We support the argument from AFGE and others that DOGE is unconstitutional.
