Grievance Consolidation Addendum

NOTICE: By submitting this form and providing the required information you will be considered to have filed the attached Grievance, and will be bound by the issues and requested remedy provided in the attached Appeal and Grievance Form. You also agree that the employee(s) named on the Appeal and Grievance Form will be representative of the group and will represent you and the group in any conferences and hearings related to the grievance, including any settlement or effort to resolve the grievance, and that you have chosen to be represented by (MPEC) Maryland Professional Employees Council, AFT- Local 6197 and/or any MPEC representative listed in the "Employee Represented by" space on the attached Appeal and Grievance form. You agree and consent to have MPEC consolidate or divide the grievance in any further or additional manner at any time as it may, in its judgment, deem prudent or necessary.

Employees Grievance:

On November 29, 2021, some Unit G employees in the casino compliance classification series at MLGCA were instructed to submit or resubmit their time submissions for hours worked on the November 25th Thanksgiving Holiday and the November 26th American Indian Heritage Holiday without the holiday pay codes for holiday overtime or comp time.

During this time, other Unit G employees were allowed to submit their time using the holiday pay codes but were required to use procedures that create an inequality of payment for the holiday hours worked. Said employees were required to code half the hours worked as holiday comp time which pays 1:1 in hours earned, vs. holiday overtime which pays 1:1.5 in cash payment.

Thanksgiving and the day after (American Indian Heritage) are observed as holidays by the State of Maryland. Employees who have their holiday pre-scheduled are required to work on that pre-scheduled holiday day, they are compensated the number of holiday hours pre-scheduled plus payment at the rate of time and one-half for the number of hours actually worked.

Requested Remedy:

Pay all Unit G employees at MLGCA Casino Properties the cash overtime rate of 1.5 for each hour worked on the November 25 & 26 holidays.

Immediately correct the egregious practice of allowing casino managers to impose questionable written and/or verbal procedures inconsistent with COMARS and state policy.
