Courts and election officials in various states have issued rulings on Trump's eligibility to serve as president based on the 14th Amendment for inciting the January 6 Capitol attack. While Colorado's Supreme Court and Maine's secretary of state found Trump ineligible, Michigan and Minnesota state supreme courts and California's secretary of state allowed him to remain on their primary ballots.
These rulings mark the first application of the Constitution's 14th Amendment, "the insurrection clause," against a presidential candidate. States that have adhered to the 14th Amendment reaffirmed that no individual is above the law, especially in instances of undermining democratic institutions. This decision sets a precedent for accountability.
The 14th Amendment to the United States Constitution provides a clear path to protect our democracy from those who would undermine it. Section 3 of the Amendment states that anyone who has taken an oath to support the Constitution but has subsequently engaged in insurrection or rebellion against the United States is disqualified from holding office.
Maine and Colorado are the first states to hold Trump accountable under the 14th Amendment, and other states must follow suit.
