In October 2016, members of the community, and members of Friends of Elizabeth Street Garden Inc. formed Elizabeth Street Garden Inc.  Elizabeth Street Garden filed their nonprofit Certificate of Incorporation with New York State.  On January 26 2017, Elizabeth Street Garden Inc. received federal tax-exempt 501(c)(3) determination from the IRS.

TO PRESERVE AND PROMOTE THE CONTINUED USE OF ELIZABETH STREET GARDEN AS UNIQUE, PUBLIC, GREEN OPEN SPACE, COMMUNITY GARDEN AND NYC PARK.

Elizabeth Street Garden Inc is a 501(c)(3) nonprofit organization incorporated in 2016 in New York with the mission to preserve Elizabeth Street Garden as unique public green, open space while maintaining the Garden's original integrity.  Contributions made for the charitable purposes of Elizabeth Street Garden are tax-deductible to the extent allowed by the law.
