Abolish Delaware's Death Penalty

UPDATE: 7pm on June 26, 2025

The Delaware House passed HB 35 by a vote of 28-12-1 on June 25. The Senate Executive Committee advanced the bill to the floor on June 26.  Now the Senate must pass it by the end of the session on June 30.  Please use this tool to write and call your Delaware Senator!

Delaware's death penalty has either been abolished or deemed unconstitutional on several occasions over the last 70 years, only to be repeatedly reinstated. In 2024, the General Assembly repealed the death penalty from the Delaware Code. HB 35 would go one step further by enshrining the ban in the Delaware Constitution, creating a strong safeguard against any future attempts at reinstatement and reactionary politics of the moment.

HB 35 will accomplish this goal. Please send an email to your Delaware state Senator to urge them to support the legislation to enshrine a prohibition of capital punishment in our state constitution.
