Union Pacific has demonstrated, repeatedly, that it has no genuine commitment to competition. Its obstruction of BNSF and CP access serves as clear evidence. Allowing UP to merge with Norfolk Southern would magnify these anti-competitive tendencies and inflict long-term harm on shippers, communities, labor and the national freight rail system.

For these reasons, the merger should be firmly rejected.
