Demand Gov. Whitmer Uphold the Constitution and Save the Raise

In July 2024, the Michigan Supreme Court ruled that a ballot initiative raising the state’s wage to $14.97 by 2030 - including for service workers and other “tipped” workers - must go into effect.

Then 8 Democratic Senators, a minority of the caucus, voted with all Republicans to change the law to exclude tipped workers from the wage guarantee.

Now, Samuel Bagenstos, professor of labor and employment law at the University of Michigan, former general counsel of the US Department of HHS and former deputy assistant attorney general in the Justice Department Civil Rights Division, has warned these lawmakers that their actions are likely unconstitutional. Tell Gov. Whitmer to reject this unconstitutional overreach and let the scheduled raises for workers go into effect Thursday.
