Next Action Step! Target Chairman Brannan to Close Florida's Rape Loophole

THIS IS A NEW ACTION STEP TO TARGET CHAIRMAN BRANNAN, of the House Criminal Justice Committee.

We have a dangerous loophole in Florida protecting rapists.

As currently defined in Florida law, a person is only mentally incapacitated if they are temporarily incapable of appraising or controlling her own conduct due to the influence of drugs or alcohol ingested without their consent.

That last part is the key issue at stake here, since not all victims of sexual assault became incapacitated involuntarily. Some of us chose to drink or take drugs or medication, BUT ISN'T THAT STILL RAPE, TOO?

Such as an 18 year old college freshman who goes to her first party, has a few beers and gets very drunk, passes out and wakes up to a man she does not know raping her. Rape should ALWAYS be considered a serious crime, no matter the victim's choices leading up to the assault.

Some studies show that by the second year of college, 1 in 4 female students report being sexually assaulted while under the influence. And this is not just an issue that effects women, as more than 1 in 10 people report being sexually assaulted in their lifetime.

HB.525/SB.868 WILL CLOSE Florida's rape LOOPHOLE, SIMPLY BY REMOVING THE LANGUAGE REGARDING WHETHER OR NOT THE DRUGS OR ALCOHOL WERE ADMINISTERED INVOLUNTARILY.

The bill clarifies and creates consistency in statutes on what constitutes sexual battery upon a person impaired by drugs or alcohol. By this legislation, an offender commits the aggravated crime if the offender knows, or has reason to believe, the victim is mentally incapacitated due to the ingestion of drugs and or alcohol.

Please help fix this grave loophole protecting rapists in Florida by emailing Representative Chuck Brannan, Chairman of the House Criminal Justice Committee, and asking him to schedule and support this bill.

All it takes is a few clicks, and no donations will be requested.

Together we can ensure justice for ALL incapacitated victims of rape in Florida.
