Tell Maine Attorney General Aaron Frey: Arrest the ICE Agent Who Killed Johan Guerrero Now
Johan Sebastián Durán Guerrero was a 26-year-old father building a life in Biddeford, Maine. He cleaned a veterinary clinic in the mornings and delivered food afterward to support his family.
On July 13, he left home for work and was shot to death by an ICE agent on the street where his family lived. His 3 year-old daughter, still in her Bluey pajamas, was in the car.
DHS has changed its story on what happened repeatedly. First they claimed Johan was shot in self defense. When the public saw video evidence that didn’t back that up, the DHS said Johan was shot to protect public safety.
Federal officials also initially told Senator Angus King that Johan was targeted for being an illegal immigrant. Again, after reporting showed Johan had a legal work permit, ICE admitted the warrant they had was actually for someone else.
The available evidence demands immediate action.
Neighbors heard 5 shots. Witnesses said agents pursued Johan’s car, struck it with an SUV, surrounded it with guns drawn, and fired almost immediately. One witness heard Johan say, “I tried to stop” just before a video of the scene shows agents pulling Johan’s limp body from the car and handcuffing him.
The ICE agent that killed Johan in broad daylight, on a public street, and in front of his 3 year-old daughter should be in jail while the incident is investigated -- just like what would happen to you, me, or anyone else that killed an unarmed civilian. Instead DHS put the agent on paid administrative leave.
Enough is enough. This ICE agent is a threat to public safety.
He killed a man in cold blood in broad daylight. How dangerous is he when no one is watching? And ICE could reinstate him and put him back on the streets at any time.
Federal agents are subject to the same state laws as everyone else. Attorney General Frey cannot allow ICE or the Department of Homeland Security to set the terms, control the timeline, or decide what consequences are appropriate.
Anything less than an arrest sends a dangerous message that federal agents can use deadly force under any circumstance and expect their badge to protect them from the consequences.
That puts every community at risk.
