Why this Action is Important
This bill will bring significant risk and cost to Hoosiers, especially immigrant Hoosiers.
It is opposed by Hoosier Asian American Power (HAAP), along with the ACLU of Indiana and Exodus Refugee Immigration,
- It increases the risk of wrongful detention and litigation.
- It conflicts with federal law. Immigration is a federal responsibility, and states can’t create or mandate broad, independent immigration enforcement powers. But this law forces local agencies and public colleges into compliance, to a degree that goes beyond what federal law allows.
- It duplicates federal law. Federal law already makes it illegal to hire an unauthorized worker. This law is unnecessary.
- It requires compliance with ICE detainers, which increases the risk of unlawful detention and raises major concerns related to the Fourth Amendment.
- Fifth, it encourages wide use of E-Verify, which we know is a flawed, error-filled system. As a result, legally authorized workers could be blocked from jobs.
- Sixth, there are privacy concerns about the bill. Annual reporting requirements categorize non-citizens who receive benefits and turn public programs into a tool to gather data about immigrants. As a result, it could deter eligible people from seeking essential services.
- It increases surveillance of immigrant communities without any clear benefit.
