On Wednesday, May 28, Donald Trump nominated Emil Bove for a seat on the United States Court of Appeals for the Third District. This one is a real doozy.

In 2019, when he was working as a federal prosecutor in Manhattan, Bove was nearly demoted for his bellicose management style. After he eventually resigned his position in government, Bove served as second chair of Donald Trump's personal legal defense team from September 2023-2024. Shortly after the 2024 election, Trump rewarded Bove for his personal loyalty by appointing him principal associate deputy attorney general. From this position, Bove was involved in many of the most extreme and retributive acts of the Trump administration to date. According to the Associated Press:
Bove ordered the dismissal of charges against the Democratic leader of America’s biggest city, accused FBI officials of “insubordination” for refusing to hand over the names of agents who investigated the Capitol riot on Jan. 6, 2021, and ordered the firings of a group of prosecutors involved in the Jan. 6 criminal cases.
Most shockingly of all, Bove has been accused by a Department of Justice whistleblower of stating, in the event that a court were to block the Trump administration's use of the Alien Enemies Act to carry out deportations, that the Department of Justice "would need to consider telling the courts 'f--- you' and ignore any such court order."

During his confirmation hearing on Wednesday, June 25, Bove stated that he "never advised a Department of Justice attorney to violate a court order." First, let's be honest: of course he is going to say that during his confirmation hearing. Second, the language that Bove used during his hearing doesn't even appear to directly contradict the claims made by the whistleblower.

This is not someone Americans need serving as a federal judge. Bove's nomination goes way beyond the decades-long Republican tradition of nominating right-wing ideologues for federal judgeships. Instead, Bove is just someone who is personally loyal to Trump, not to the rule of law any particular political viewpoint. Also, at the age of only 44, if confirmed he would sit on the bench for decades to come.
