North Carolina’s trees and communities face serious threats from legislation that weakens local governments’ ability to protect our environment and quality of life.

We oppose North Carolina Senate Bill 205 (formerly North Carolina House Bill 765), which threatens to erode the ability of local communities to shape thoughtful, inclusive development. While the bill is presented as an affordable housing solution, it strips away key planning tools that cities like Wilmington rely on to manage growth, protect neighborhood character, and preserve green infrastructure. If passed, Senate Bill 205 would strip municipalities of critical land-use authority, allowing for development that prioritizes speed and sprawl over local input, environmental sustainability, and long-term public health. After bipartisan backlash, HB 765 stalled in the House of Representatives, but its most damaging provisions were rolled into North Carolina Senate Bill 205, a sweeping piece of legislation that used to just be about swimming pools.

At the same time, we support NC Senate Bill 587 (Clarifying Nonconforming Uses), which would restore local governments’ authority to down-zone properties—an essential tool to protect neighborhoods, manage growth responsibly, and preserve natural areas. SB 587 passed the Senate unanimously on May 7 and now awaits action in the House Rules Committee. Downzoning helps communities respond to explosive growth, preserve tree canopy, reduce flooding risks, and maintain the unique character of our region.
