Your Letter

I urge you to oppose HR 2289, which recently passed in the House Energy & Commerce Committee.

Please contact House leadership and urge them not to bring this legislation to the floor and ensure that no pieces of this bill are inserted into other bills.

HR 2289 is being incorrectly described as “streamlining broadband permitting.” In fact, it will not improve broadband connectivity for underserved Americans. Instead, it will hand free reign to communications companies to place wireless facilities wherever they like – and almost completely eliminate states’ rights and local zoning over the placement of wireless facilities.

State and local governments are already working hard to deploy broadband for their residents. Unfortunately, industry wants to avoid protections for health and safety to make profits at the expense of sickness, disability, and death for everyday Americans. These actions go against the majority’s stated commitment to states’ rights, property rights, and the White House’s Make America Healthy Again priorities.

In addition, I urge you to amend HR 1343, 1588, 1665, 1681, 1731, and 6046 to exclude wireless from the applicability of these bills. HR 6046 should be further amended to preserve the Federal Railroad Administration jurisdiction over railway safety. Congress should not advance any legislation encouraging the deployment of wireless facilities or increasing the density of radiofrequency radiation in the United States until the FCC has complied with an order issued by the DC Circuit in 2021 in the case Environmental Health Trust, et al. v. FCC (DC Cir 2021, No. 20-1025), ordering the FCC to address 11,000 pages of evidence on adverse impacts of wireless radiation.

Instead, I urge you to cosponsor our proposed legislation requiring the FCC to comply with the court order and the will of Congress, as set out in the Administrative Procedures Act. HR 2289’s preemption provisions are opposed by the National Association of Counties, the US Conference of Mayors, and the National League of Cities.

I urge you to oppose HR 2289.
