The Supreme Court is broken. There’s no polite way of putting it. Clarence Thomas’ ethical scandals haven’t disappeared. Sam Alito’s disdain for American democracy hasn’t diminished. Amy Coney Barrett is still the daughter of a highly placed Shell Oil attorney. Brett Kavanaugh is still a sexual abuser. John Roberts and Neil Gorsuch still have weird views of Trump’s absolute executive power. One good decision on tariffs doesn’t negate everything else they’ve done.
Congressional Democrats need to assert their power as a co-equal branch of government.
Fortunately, when Biden was still President he called on Congress to quickly establish term limits and an enforceable ethics code for the court’s nine justices. He also called on lawmakers to ratify a constitutional amendment limiting presidential immunity in a direct rebuke to the Trump v United States verdict that declared Presidents above the law for 'official' acts.
Every Democrat in and out of Congress is already sketching a progressive agenda once Democrats flip the Congress in 2026 and elect a better President in 2028. Supreme Court reform needs to be atop the list.
